New Orleans Couldn’t Stick to Its Guns

This video is from Glenn Beck’s television show on July 2, 2008. The footage taken by the NRA in the aftermath of Hurricane Katrina had never before been shown on national television. Wait until you see this!

I suspect that martial law was declared which effectively suspends the Constitution including the Bill of Rights. Let me check this.

YUP. From an article on Aug 31, 2005: New Orleans Mayor Ray Nagin declared Martial Law in the city and directed the city’s 1,500 person police force to do “whatever it takes” to regain control of the city. Nagin said that Martial Law means that officers don’t have to worry about civil rights and Miranda rights in stopping the looters.

(…or I might add, in stopping law abiding citizens from having guns. Who knows, they might interfer by protecting their own lives and property. It seemed this was good time for law enforcement to enjoy a power trip without fear of disciplinary consequences. After all, they were just obeying orders and doing whatever it took.)

This is an interesting take about the guns taken away…Sept 10 2005

Louisiana statutory law does allow some restrictions on firearms during extraordinary conditions. One statute says that after the Governor proclaims a state of emergency (as Governor Blanco has done), “the chief law enforcement officer of the political subdivision affected by the proclamation may…promulgate orders…regulating and controlling the possession, storage, display, sale, transport and use of firearms, other dangerous weapons and ammunition.” But the statute does not, and could not, supersede the Louisiana Constitution, which declares that “The right of each citizen to keep and bear arms shall not be abridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person.” The power of “regulating and controlling” is not the same as the power of “prohibiting and controlling.” Prohibiting was and is an illegal order.
