CA Supreme Court Refuses Stay

The California Supreme Court, today, denied a request for a stay on its ruling legalizing same-sex marriage in California until after voters have been able to decide the issue at the ballot box in November. This clears the way for same-sex nuptials to begin June 17, not only for California couples, but for residents of other states who travel to California to have marriages performed.The request for a stay was submitted by the Campaign for California Families and the Proposition 22 Legal Defense and Education Fund. The Attorneys General of nine states had also entered an amicus brief in the case saying that the ruling would cause legal chaos in their states. If the marriage protection amendment passes in California in the fall, additional confusion will come to that state for those whose marriages were performed by the state from now until then.
The decision was a 4-3 split with justices lining up just as they had on the May 15th decision legalizing same-sex marriage.
The judicial arrogance here is breathtaking-because the proposed amendment has now been certified and is definitely on the ballot, but the justices are saying, in effect, that they know better than the people and can impose their will even though they know a vote is imminent.
The only upside is that perhaps this will galvanize the people of California who care about marriage and families to rise up and save this situation for the whole nation.
