California Supreme Court overturns gay marriage ban

SAN FRANCISCO (AP) - The California Supreme Court has overturned a ban on gay marriage, paving the way for California to become the second state where gay and lesbian residents can marry. The case involved a series of lawsuits seeking to overturn a voter- approved law that defines marriage as a union between a man and a woman.

With the ruling, California could become the second state after Massachusetts where gay and lesbian residents can marry.

“What happens in California, either way, will have a huge impact around the nation. It will set the tone,” said Geoffrey Kors, executive director of the gay rights group Equality California.

California already offers same-sex couples who register as domestic partners the same legal rights and responsibilities as married spouses, including the right to divorce and to sue for child support. It’s therefore unclear what additional relief state lawmakers could offer short of marriage if the court renders the existing ban unconstitutional.

A coalition of religious and social conservative groups is attempting to put a measure on the November ballot that would enshrine California’s current laws banning gay marriage in the state constitution.

The Secretary of State is expected to rule by the end of June whether the sponsors gathered enough signature to qualify the marriage amendment, similar to ones enacted in 26 other states.

The cases before the California court were brought by the city of San Francisco, two dozen gay and lesbian couples, Equality California and another gay rights group in March 2004 after the court halted San Francisco’s monthlong same-sex wedding march that took place at Mayor Gavin Newsom’s direction.

This would open the way for a lot more adoptions. We can’t learn from history. This screwed up the Greeks and later the Romans. It’s a pretty easy pattern to see.

These judges believe they have the right to decide what the law is. They are guilty of destroying our republican form of government.

The LDS Church came out with a strong statement against this ruling. I am very proud of them that they stood up to this pressure. It isn’t going to get easier. Some things are black and white. Marriage was ordained of God to be between a man and a woman. The family is the basic building block for society and this kind of things will destroy society given time.

If America ceases to be good, she will cease to be great. With all the problems in our country and the world it is sad that so many just don’t get it.

BTW it is legal for gays to marry in any state. It is just not legal for state to define it as marriage or for an official to perform the marriage on behalf of the state. Activist judges are trying to take away our freedom and make us call it marriage. I never will.

Let people “marry” who or what they want- just don’t force me to call it marriage.

That’s right. No matter what the judges do they can’t force me to accept it as marriage. That makes me feel a little better. I hope other churches don’t cave on this. I know my church wont. I’m Catholic and we feel pretty strong about this.

It’s a big development, but not the last word on the subject even in California, given the Proposition to change the State Constitution that will be on the California ballot this fall.

I’m no longer religious in a denominational sense and so can try to view the issue as a secular political question of: “does American society today want to extend the marriage subsidy to gay unions?” Given what’s happening in Massachussets and now California, the answer may turn out to be “yes”–although I somehow doubt it. I come from a fundamentalist Protestant background and certainly understand how many Christians who read the Bible would feel on this one. A few major churches, including the Episcopal church, I believe, now accept the idea of gay marriage; but, it’s hard to see how they can get around the rather clear and blunt prohibitions in the Bible, going all the way back to the Levitical Law and the examples of Sodom and Gomorrah. Yes, there are favorable depictions of intense same-gender friendships–David and Jonathan, Ruth and Naomi, etc.–but that’s hardly the same thing.
